Basic Terms and Conditions
(a PDF of these terms to be signed will be emailed directly to you upon agreement to commence work).​

This Agreement, to be read in conjunction with the ‘Proposed Artwork Commission’ form is made between the Artist and the Art Collector as follows: 

1. The Artwork: The Art Collector (name indicated in form below) is commissioning the Artist (Paul Krikau) to paint an original cartoon in ink & watercolor on paper, digitally, or both as indicated on the form below.

2. The Concept: The Artist will paint an original artwork in the media indicated on the form.

3. Progress Report:The Artist agrees to furnish the Art Collector with progress reports during the creation of the work, which can include pictures of the work in progress. The pictures will be digital images and sent by email, unless other arrangements are made and agreed upon by both parties prior to the contract's execution.

4. Payment Amount: The price will be decided by the Art Collector and the Artist beforehand and be based upon image size and complexity of the completed work and will be consistent with other comparable works by the Artist at the time of sale. Artwork size will be mutually determined by the Artist and the Art Collector. If the artwork is to be shipped in the 48 contiguous states of the United States of America, the cost of shipping (USPS) will be included in the agreed upon price. The cost of shipping outside the contiguous 48 states will be paid by the Art Collector, including tracking, insurance and destination taxes.

5. Payment Schedule:A non-refundable deposit of 10% of the total price to cover the Artist’s initial material costs is required before commencement of artwork. The remaining balance of payment is due upon delivery of the completed artwork.

6. Copyright:The Artist retains the copyright to all works commissioned by the Art Collector that were created by the Artist, including all reproduction rights and the right to claim statutory copyright. No artwork may be reproduced or altered without the written consent of the Artist.

7. Right of Refusal:In the event that the Art Collector does not wish to purchase the commissioned artwork, the Art Collector may refuse. In that case, the Artist will retain the refused artwork and the non-refundable deposit. This is free of any claims or interests of the Art Collector and the Art Collector will not owe any additional fees to the Artist. 

In signing this document, the Artist acknowledges that the Artist will complete the work as specified and deliver the work to the Collector within the agreed time frame.

In signing this document, the Art Collector acknowledges that the Art Collector will pay the payment price as described above and will take ownership of the artwork on completion of payment.
